The Whistlr Network Terms of Service constitute a comprehensive legal framework governing the relationship between users and ETAProjects Inc., establishing rights, responsibilities, and obligations for all parties engaged with our platform. These terms incorporate industry best practices, regulatory compliance requirements, and user protection mechanisms while providing clear guidelines for acceptable use, content policies, and dispute resolution procedures.
Legal Foundation and Contractual Framework: Binding Agreement and Jurisdiction
By accessing or using Whistlr Network services, you enter into a legally binding agreement with ETAProjects Inc., governed by the laws of the State of California, United States. This agreement supersedes all previous versions and constitutes the complete understanding between parties regarding platform usage. The terms incorporate applicable federal and state laws, international treaties, and regulatory requirements including but not limited to the Communications Decency Act, Digital Millennium Copyright Act, and relevant privacy legislation.
- Age Requirements and Legal Capacity: Users must be at least 18 years of age or have explicit parental/guardian consent and supervision. Minors between 13-17 require verifiable parental consent and are subject to additional privacy protections under COPPA and similar regulations
- Account Registration and Identity Verification: Users must provide accurate, current, and complete information during registration and maintain the accuracy of account information throughout platform usage. False information may result in account suspension or termination
- Security and Access Control: Users are solely responsible for maintaining the confidentiality of login credentials, monitoring account activity, and immediately reporting unauthorized access or security breaches to our security team
- Intellectual Property Rights and Content Licensing: Users retain ownership of their original content but grant Whistlr a worldwide, non-exclusive, royalty-free license to use, display, and distribute content as necessary for platform operation and feature provision
- Community Standards and Acceptable Use: All users must comply with our comprehensive community guidelines, which prohibit harassment, hate speech, illegal activities, spam, impersonation, and other behaviors that harm the platform community or violate applicable laws
- Reporting and Cooperation Obligations: Users must report violations of terms or illegal activities and cooperate with investigations, law enforcement requests, and safety measures as required by law and platform policies
- Privacy and Data Protection Compliance: Users acknowledge and consent to data processing activities described in our Privacy Policy and agree to comply with applicable privacy laws when interacting with other users' personal information
- Commercial Use and Business Activities: Commercial activities on the platform are subject to additional terms, tax obligations, and compliance requirements. Users engaging in business activities must comply with applicable business laws and regulations
Enforcement Philosophy and Progressive Discipline: Whistlr employs a progressive enforcement approach that prioritizes education and rehabilitation over punitive measures. Our enforcement actions are designed to protect the community while providing users with opportunities to understand and correct violations. We believe in proportional responses that consider intent, impact, and user history while maintaining consistent application of community standards. Serious violations that threaten user safety or legal compliance may result in immediate account suspension or termination.
Service Availability and Platform Modifications: Whistlr reserves the right to modify, suspend, or discontinue any aspect of the service at any time with or without notice. We strive to provide reliable service but cannot guarantee uninterrupted availability due to maintenance, technical issues, or circumstances beyond our control. Users acknowledge that the platform may evolve and that features may be added, modified, or removed as part of ongoing development and improvement efforts.
Limitation of Liability and Disclaimers: Comprehensive Legal Protections
Whistlr Network is provided "as-is" without warranties of any kind, either express or implied. ETAProjects Inc. disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement. Our liability is limited to the maximum extent permitted by law, and users acknowledge that social media platforms involve inherent risks including potential exposure to offensive content, privacy breaches, and technical failures.
Indemnification and User Liability: Users agree to indemnify and hold harmless ETAProjects Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from user conduct, content, or violations of these terms. This includes legal fees, regulatory fines, and damages resulting from user actions that violate laws, infringe rights, or harm other users or third parties.
Dispute Resolution and Legal Procedures: Alternative Dispute Resolution Framework
Disputes arising from platform usage are subject to binding arbitration under the rules of the American Arbitration Association, with proceedings conducted in Los Angeles County, California. Users waive the right to participate in class action lawsuits and agree to resolve disputes individually through arbitration. Upon termination, user rights to access the platform cease immediately, though certain provisions including intellectual property licenses and indemnification obligations survive termination.
International Compliance and Cross-Border Considerations
Whistlr operates globally and complies with applicable laws in jurisdictions where we provide services. Users accessing the platform from outside the United States acknowledge that they are responsible for compliance with local laws and regulations. Content and data may be stored and processed in multiple countries, and users consent to such cross-border transfers subject to applicable privacy laws and data protection agreements.
Amendment Procedures and Notice Requirements: These terms may be updated periodically to reflect legal changes, new features, or policy updates.
