Terms of Service
Complete terms of service covering platform usage, user responsibilities, content policies, and legal agreements for all ETAPX services
These Terms of Service ("Terms") constitute a binding legal agreement between you and ETAPX, Inc. ("ETAPX," "we," "us," or "our") governing your access to and use of Whistlr Network (social networking platform), Influxx (professional networking services), Ocsidian (business productivity tools), Flow (live streaming platform), and all associated services, websites, mobile applications, desktop applications, and related technologies (collectively, the "Services"). By creating an account, accessing any Service, or using any functionality provided through our platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

1. Acceptance and Eligibility By accessing or using our Services, you confirm that you are at least 13 years old (or 16 in the European Union), have the legal capacity to enter into this agreement, and agree to comply with these Terms. If you are using our Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Age Requirements: Users must be at least 13 years old globally, or 16 years old in the European Union, to create an account. Users between 13-17 (or 16-17 in the EU) may use our Services with parental consent and supervision. We reserve the right to verify age and may request identification documents for verification purposes.
2. Account Creation and Security You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, complete, and current information during registration and to update such information as necessary to keep it accurate and complete.
Account Responsibilities:
  • Provide truthful and accurate registration information
  • Maintain security of passwords and authentication credentials
  • Notify us immediately of any unauthorized account access
  • Use only one account per person (no multiple or fake accounts)
  • Keep contact information current for important service communications
  • Comply with our Community Guidelines and content policies
3. Acceptable Use and Community Guidelines Our Services are designed to foster positive, authentic human connection and creative expression. You agree to use our Services responsibly and in accordance with applicable laws, these Terms, and our Community Guidelines. Prohibited activities include but are not limited to harassment, spam, fraud, and sharing of illegal or harmful content.
Prohibited Content and Activities:
  • Harassment and Abuse: Bullying, stalking, threatening, or intimidating other users
  • Hate Speech: Content that promotes violence or hatred based on protected characteristics
  • Illegal Activities: Using our Services for any unlawful purpose or to facilitate illegal activities
  • Spam and Manipulation: Sending unsolicited messages, fake engagement, or platform manipulation
  • Adult Content: Sexually explicit material, pornography, or sexualized content involving minors
  • Violence and Harm: Graphic violence, self-harm promotion, or dangerous activities
  • Intellectual Property Infringement: Sharing copyrighted content without authorization
  • Privacy Violations: Sharing private information without consent or doxxing
  • Impersonation: Pretending to be another person, brand, or organization
  • Misinformation: Deliberately false information that could cause harm
4. User Content and Platform Usage License You retain all right, title, and interest in and to any content, materials, information, data, text, software, music, sound, photographs, graphics, videos, messages, or other materials ("User Content") that you submit, post, upload, or otherwise make available through the Services. By submitting User Content to any of our Services, you hereby grant to ETAPX a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable license to use, copy, modify, distribute, publicly display, publicly perform, reproduce, translate, and create derivative works of such User Content, in whole or in part, in any format or medium now known or later developed.
Scope of License Grant: The license granted herein is limited to the operation, provision, promotion, and improvement of the Services across Whistlr Network, Influxx, Ocsidian, and Flow platforms. This includes, but is not limited to: (a) displaying User Content to other users in accordance with your privacy and sharing settings; (b) processing User Content through our technical systems for indexing, search, recommendation algorithms, and content delivery; (c) creating derivative works for the purpose of formatting, resizing, or optimizing User Content for different devices and platforms; (d) distributing User Content through our content delivery networks and backup systems; and (e) enabling user-initiated sharing, embedding, and syndication features across our Services and authorized third-party platforms.
Connected Accounts and Platform Network Integration ETAPX operates an interconnected ecosystem of platforms designed to provide seamless user experiences across professional, social, and business contexts. When you choose to connect accounts across Whistlr Network, Influxx, and Ocsidian, you authorize the sharing of specified profile information, content, and usage data between platforms in accordance with your privacy preferences and the technical requirements for cross-platform functionality.
Cross-Platform Data and Content Sharing:
  • Professional Identity Synchronization: Verified status, professional credentials, and business affiliations may be shared between Influxx and Ocsidian to maintain consistent professional identity across business-focused platforms
  • Social Network Integration: With user authorization, connections and contact information may be synchronized between Whistlr Network and Influxx to facilitate professional networking based on existing social relationships
  • Content Cross-Posting: Users may choose to automatically or manually share content across connected platforms, subject to platform-specific content policies and audience targeting preferences
  • Single Sign-On and Authentication: Connected accounts may utilize unified authentication systems for streamlined access while maintaining platform-specific privacy and security controls
  • Analytics and Usage Data: Aggregated usage patterns and engagement data may be shared across platforms to improve recommendation algorithms and user experience optimization while maintaining individual privacy protections
Content Retention and Deletion: You may delete User Content at any time through platform-specific controls or account settings. Upon deletion, ETAPX will use commercially reasonable efforts to remove such content from active systems within a reasonable timeframe, typically within ninety (90) days. However, you acknowledge that: (a) deleted content may persist in backup systems, cached versions, and distributed storage for technical and security purposes; (b) content that has been shared, embedded, or redistributed by other users may remain accessible through those channels; (c) ETAPX may retain copies of User Content as required by applicable law, legal proceedings, or platform safety requirements; and (d) complete removal from all distributed systems may require additional time due to technical constraints inherent in cloud-based architectures.
Algorithmic Improvement and Automated Systems: You acknowledge and consent to the use of User Content, usage patterns, and behavioral data to train, improve, and operate machine learning algorithms, artificial intelligence systems, and automated decision-making processes across our Services. These systems are designed to enhance user experience, improve content relevance, detect and prevent abuse, and optimize platform performance. Algorithmic processing may result in automated decisions regarding content visibility, recommendation rankings, and user experience personalization, subject to your right to object and request human review as provided in our Privacy Policy.
5. Live Streaming and Creator Features Our Flow streaming platform and creator tools enable real-time broadcasting, content monetization, and professional content creation. Users of these features must comply with additional guidelines regarding content quality, community interaction, and monetization practices.
Live Streaming Guidelines:
  • All community guidelines apply to live content with enhanced enforcement
  • Real-time moderation tools must be used for chat and audience management
  • Co-hosting and collaborative features require consent from all participants
  • Monetization features are subject to eligibility requirements and tax compliance
  • Professional streaming tools must be used in accordance with technical specifications
  • Music and copyrighted content must comply with licensing requirements
6. Privacy and Data Protection Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our data practices as described in the Privacy Policy.
We implement comprehensive privacy protections and give you control over your personal information. Our privacy practices comply with applicable data protection laws including GDPR, CCPA, and other regional privacy regulations. You may access, correct, or delete your personal information at any time through your account settings or by contacting our privacy team.
Platform Philosophy: ETAPX is built on principles of user empowerment, authentic connection, and ethical technology development. We believe social platforms should serve users rather than exploit them. Our business model prioritizes user value over advertiser interests, and our technology is designed to promote healthy digital relationships and communities.
7. Payments, Subscriptions, and Monetization Our Services include paid features, subscriptions, and creator monetization options. All payments are processed securely through our payment partners. Subscription fees are billed in advance and are non-refundable except as required by applicable law or as specified in our refund policy.
Payment Terms:
  • Subscriptions: Automatically renewable unless cancelled, with pro-rated billing for upgrades/downgrades
  • Creator Monetization: Revenue sharing subject to eligibility requirements and tax withholding
  • In-App Purchases: Digital goods and premium features purchased through secure payment processing
  • Refunds: Available within 30 days for subscription services, subject to our refund policy
  • Tax Compliance: Users responsible for applicable taxes on earnings and purchases
  • Payment Methods: Credit cards, digital wallets, and other approved payment methods
8. Platform Availability and Service Level We strive to provide reliable, high-performance services but cannot guarantee uninterrupted availability. Our Services are provided "as is" and "as available." We reserve the right to modify, suspend, or discontinue any part of our Services with reasonable notice.
Service Modifications: We continuously improve our Services through updates, new features, and performance enhancements. We will provide reasonable notice of material changes that significantly impact functionality. Your continued use of our Services after such changes constitutes acceptance of the modifications.
9. Enforcement and Account Actions We reserve the right to investigate violations of these Terms and take appropriate action including content removal, account warnings, temporary suspensions, or permanent account termination. Our enforcement decisions are made based on violation severity, user history, and community impact.
Enforcement Actions:
  • Content Removal: Deletion of specific posts, comments, or media that violate policies
  • Feature Restrictions: Temporary limitations on posting, messaging, or live streaming
  • Account Warnings: Formal notice of policy violations with explanation and guidance
  • Temporary Suspension: Time-limited account restriction with opportunity for review
  • Permanent Termination: Complete account removal for severe or repeated violations
  • Appeal Process: Right to contest enforcement decisions through formal review procedures
10. Third-Party Integrations and External Services Our Services may integrate with third-party services, applications, and content. These integrations are subject to the terms and privacy policies of the respective third parties. We are not responsible for third-party services or content accessed through our platform.
Integration Examples: OAuth authentication with Google, Apple, and Microsoft; music integration with Apple Music and Spotify; payment processing with Stripe; cloud storage services; and social media cross-posting features. Each integration requires your explicit consent and may be revoked at any time through your account settings.
11. Intellectual Property Protection We respect intellectual property rights and expect our users to do the same. We respond to valid copyright takedown notices under the Digital Millennium Copyright Act (DMCA) and equivalent international laws. Repeat copyright infringers may have their accounts terminated.
Copyright Infringement Reporting To report copyright infringement, send a DMCA notice to our designated agent at legal@etapx.us. Include: (1) identification of copyrighted work, (2) location of infringing material, (3) your contact information, (4) statement of good faith belief, (5) statement of accuracy under penalty of perjury, and (6) your physical or electronic signature.
12. International Use and Export Controls Our Services are available globally but may be subject to export controls and local laws. You are responsible for complying with applicable laws in your jurisdiction. Some features may not be available in certain countries due to legal restrictions.
We comply with U.S. export control laws and regulations, including restrictions on certain countries, entities, and individuals. Users in restricted jurisdictions may not have access to all features or services. We reserve the right to restrict access based on geographic location or legal requirements.
13. Limitation of Liability and Disclaimers TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETAPX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OUR SERVICES.
Our Services are provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our Services will be uninterrupted, secure, or error-free, or that defects will be corrected.
14. Indemnification You agree to indemnify, defend, and hold harmless ETAPX, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from your use of our Services, violation of these Terms, or infringement of third-party rights.
15. Dispute Resolution and Governing Law These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration under the American Arbitration Association's Commercial Arbitration Rules, except for claims that may be brought in small claims court.
Arbitration Agreement: By agreeing to these Terms, you waive your right to jury trial and class action participation for most disputes. You may opt out of arbitration within 30 days of account creation by emailing legal@etapx.us. EU and UK users retain rights to bring disputes in local courts as provided by applicable consumer protection laws.

17. Changes to These Terms We may update these Terms periodically to reflect changes in our Services, applicable laws, or business practices. Material changes will be communicated through prominent notice on our platform, email notification, or other appropriate methods at least 30 days before taking effect.
Your continued use of our Services after such notice constitutes acceptance of the updated Terms. If you do not agree to the changes, you may terminate your account before the effective date. We will maintain previous versions of our Terms for reference and provide clear summaries of significant changes.
